Huge win for 2A in VT, Update on Bills in play

News from the VTFSC you'll want to know about
 ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌

Bernard -

We had previously warned you about S4, a bill which contained a section that would prohibit those under 21 from possessing an "Assault Weapon", with that section providing definitions of what makes a pistol, rifle or shotgun into an "Assault Weapon".

As of yesterday, and after intense lobbying by the VTFSC, as well as work done by our allies in GOVT, the VTFSC is pleased to report that the Senate Judiciary Committee, on a 5-0 vote, opted to pull that section out of the bill completely.  It's gone (for now).

Yes, you read that correctly:  We were able to have a section pertaining to an "Assault Weapon Ban" dropped, due entirely to it's lack of constitutionality under Bruen.

This is a huge win for the 2nd Amendment in Vermont, but this is only one battle in the long and protracted fight for our rights, and it occurred only because Senate Judiciary is a very deliberative body who did the right thing when presented with the facts and supporting information.

On other fronts:  The VTFSC gave testimony yesterday on H.230 in the House Health Care Committee, which is billed as an anti-suicide bill.  This bill contains a section relating to "Safe Storage" (Lock Up Your Guns) as well as a Waiting Period (either 48 or 72 hours).

In the testimony we gave on H.230, and among other concerns, we pointed out that "Safe Storage" as written defies the Heller Decision, and we further stated that a Waiting Period would likely not survive a challenge under Bruen.  We concluded our testimony with a quote from Dr. Martin Luther King:  "A right delayed is a right denied".

The House Health Committee however is not really interested in whether things are constitutional or not, which is why this bill - when it passes the Health Care Committee - will be moved into House Judiciary.  THAT is the committee that will have to really listen to our constitutional arguments, and we will be READY.

Stay tuned:  There is a huge push to move H.230, and some version WILL be passed by the super-majority, but we will continue to fight that all bills relating to firearms are Constitutional.

In regards to other bills in play, the VTFSC maintains a listing of bills we are watching on our website, or you can see that list here.

Our calendar of events is also on the website here.

Alert on S.57

Senate Bill S.7 attacks our ranges
 ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌

Bernard -

This message is a CALL TO ACTION on S.57 - An act relating to expanding municipal authority over the discharge of firearms - which seeks to alter 24 VSA 2291.

Currently, Section (8) of 24 VSA 2291 gives a municipality the authority "To regulate or prohibit the use or discharge, but not possession, of firearms within the municipality or specified portions thereof, provided that an ordinance adopted under this subdivision shall be consistent with 2295 of this title and shall not prohibit, reduce, or limit discharge at any existing sport shooting range..."

What they want to change is to drop the phrase:  "reduce, or limit".

Make no mistake:  This bill has the potential to close every club range in Vermont by severely limiting the ability to shoot at a facility designed for that purpose.

Back in 1987, the VTFSC worked hard to get 24 VSA 2295 passed, which is commonly referred to as the Sportsman's Bill of Rights, with this statute giving very limited authority to a municipality over firearms and ammunition, as well as activities such as hunting and fishing.

In 1991, the VTFSC was again pivotal in getting 10 VSA 5227 passed, commonly referred to as the Range Protection Act, which essentially prevented people who move onto property that abuts a range from being able to argue that noise from the range bothers them.

If anything, we want to ENCOURAGE people to use our sport shooting ranges, as the alternative is people shooting in places that may not be as safe.

Right now, this bill has been assigned to the Senate Committee on Government Operations, but has not yet begun to move.

Before it does start to move, and even after it starts to move, we need to SLAM that committee, as well as the Senate Pro Tem Baruth, about our extreme displeasure that such a bill is even being considered.

We politely request that you take 2 minutes to send an email to the following people (you can just copy from the list and then paste into an email address line), with a subject line of "NO TO S.57", and any polite text you wish to include in the body of that email.

Once you do that, contact 2 of your friends to have them do the same thing:  We want to kill this before it even starts to move.  Next week, send another email.

2023 VTFSC Legislative Update

Your latest update on the 2023 Legislature
 ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌

Bernard -

We have some updates on bills we previously reported, as well as some new bills to report, none of which are good.

For 2nd Amendment rights, we previously reported the following:

  • S.3 - Prohibiting paramilitary training camps
  • S.4 - Reducing juvenile violence, and
  • S.11 - Persons prohibited from possessing firearms

Of those, we will be giving our testimony on S.4 tomorrow morning at 9AM, and we are READY.  While we have concerns about several sections, our primary concern is Section 8 - which bans people under 21 years of age from possessing "assault weapons", and it includes definitions of "assault pistol", "assault shotgun" and "assault rifle".  Section 8 will not stand constitutional scrutiny because both age 21 prohibitions and "assault weapons" bans have been struck down by courts as being unconstitutional under the new Bruen standard.

The list of 2nd Amendment Case we have built to support our testimony can be found here.

S.3 will have a walk-thru on Thursday morning at 10:45.  While we are currently on the agenda to provide testimony, we will be providing testimony later on this bill.

Since our last message to you, there have been 3 additional firearm related bills added - all of which are SERIOUSLY flawed:

  • S.21 - Safety zones around occupied buildings
  • S.31 - Ban on open carry; limit defense and sensitive places, and
  • H.98 - Firearm storage; expand ERPO; 10-day waiting period; guns in bars and prohibit possession by hate-crime people

We will be aggressively fighting each of those.

On the F&W side of things:  We now have S.22 which allows for posting your land permanently by using purple paint.  It's seriously flawed as well.

We will keep you informed as things develop; please forward this to like-minded friends and have them join our email list at our website.

The more people we can keep informed the better.

If you like what you see here, please consider a donation, come to our banquet, buy a raffle ticket or even better:  Do all three!

Thank you for your continued support of the VTFSC and our member clubs.

2023 Legislative Update

Your latest update on the 2023 Legislature
 ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌ ‌

Bernard -

As you know, the Vermont Legislature now has a progressive/democrat super-majority that is veto proof.  If we didn't have our work cut out for us before, we sure as heck do now.

As of this evening, 1/13/23, there are a total of 54 House Bills and 16 Senate bills in play.

On the House side, we currently see no bills that affect either Firearms or our sporting activities.  We expect however that we will see at least a Child Access Prevention bill (lock up guns), and a waiting period bill.  We may also see a "local Control" bill, something that GunSense Vermont is falling all over themselves for.

On the Senate side, we currently see three bills that affect Firearms (Article 16 / 2nd Amendment), and none that affect our sporting activities:

  • S.3 relates to the prohibition of paramilitary training camps
  • S.4 relates to juvenile and criminal procedures
This bill addresses several areas; some good, a couple of concern, and 1 bad.  The couple of concern deal with the making of Vermont laws that are redundant to existing Federal Law.  The bad deals with prohibiting persons under 21 from owning "assault weapons" (Section #8).
  • S.11 relates to criminal procedures, persons prohibited from possessing AND a 72-hour waiting period

S.4, which has 11 working sections, was taken up this morning with the VTFSC being present in the limited-capacity room.  (9AM-10AM, 10:20AM-11:15AM).  That process begins with one of the lawyers from Legislative Counsel doing a section by section walk thru, explaining what each does.

Of special note during this walk thru is that, just prior to launching into section #8, legal counsel stopped to give the Committee a brief overview of the NYSRP v Bruen, as well as some of what has resulted so far in successful challenges to existing law under the new standard of scrutiny that must now be used on 2nd Amendment Cases.  Section #8 by the way includes definitions of what an "assault shotgun" is, what an "assault pistol" is, and of course an "assault rifle" is.  You will be saddened at what these definitions will prohibit for those under 21, and we all should know the real goal is to get a definition established for those under 21, and then pass another law later to have it apply to the rest of us.

Anyway, back to Bruen.  You'd be amazed at what has been, and is being, overturned.  Under Age 21 possession prohibitions.  "Assault Weapon" Bans.  High-Capacity Magazine Bans.  Even Extreme Risk Protection Order/Red Flag laws that allow the taking of firearms without due process are being successfully challenged.  More are on tap.

Testimony on S.4 will begin next Friday 1/20 at 9AM, with the VTFSC being scheduled for later in the morning.  We are, and will be, ready.

We will keep you informed as things develop; please forward to like-minded friends and have them join our email list at our website.

Thank you for your continued support of the VTFSC and our member clubs.

Sportsmen's Alliance and Vermont Hunters, Sue to Restore Refuge Rights

On Sept. 14, the Sportsmen's Alliance Foundation, joined by the Vermont Traditions Coalition, Vermont Federation of Sportsmen's Clubs and the Vermont Bear Hound Association, filed suit against the U.S. Fish and Wildlife Service (FWS) seeking to overturn hunting restrictions on Conte National Wildlife Refuge.

On Aug. 16, 2021, FWS released new regulations governing hunting on the refuge, including major reductions in the bear hound-training season, and the elimination of nearly all hunting with dogs on the Putney Mountain Unit of the refuge.

"Federal law requires FWS to show the public their plans before enactment so they can gather public input," said Todd Adkins, vice president of government affairs for the Sportsmen's Alliance Foundation. "This prevents arbitrary governing and is foundational in a functioning and fair democracy, but the Biden Administration failed to comply, denying Vermont citizens a voice that is guaranteed in law."

"Hunters were completely blindsided by the hunting restrictions because the U.S. Fish and Wildlife Service failed to provide any notice or opportunity for public comment despite the drastic changes," continued Chris Bradley, president of the Vermont Federation of Sportsmen's Clubs. "The government's lack of transparency is the focus of our lawsuit."

"Bear hunters rely on the summer training season to condition their dogs for the fall hunting season," said Doug DeVost, president of Vermont Bear Hound Association. "That training is essential to maintain healthy, well-trained dogs in the field, and yet FWS didn't even give us the courtesy of hearing our input on the impact of this decision."

"The Fish and Wildlife Service had ample opportunity to share their plans to restrict hunting rights on the refuge with Vermont sportsmen and women but completely failed to do so,  leaving it out of their draft plans for Conte, making no mention of the changes in public meetings or other communications.  FWS even stated in a draft hunt plan that the refuge intended to continue the status quo of allowing hunters to hunt with their dogs on the refuge in compliance with Vermont state law," said Mike Covey, executive director of the Vermont Traditions Coalition.

The four organizations believe that the precedent of allowing the federal government to hide new rules while denying public input was too much to ignore. The groups are asking the court to vacate the restrictions and are seeking the reimbursement of legal costs to defend a fundamental and basic tenant of federal law.

About Sportsmen's Alliance: Working in all 50 state legislatures, the Sportsmen's Alliance protects and defends America's wildlife conservation programs and the pursuits - hunting, fishing, trapping and recreational shooting - that generate the money to pay for them. Sportsmen's Alliance Foundation is responsible for public and youth education, legal defense in state and federal court and research to guide the decision-making process of all involved. Its mission is accomplished through several distinct programs coordinated to provide the most complete defense capability possible.
