Bernard --  On Christmas Eve 1776 General George Washington and 2400 soldiers braved the freezing cold and ice to cross the Delaware river to attack a garrison of Hessian soldiers under the command of the British crown stationed near Trenton New Jersey. These brave men left the comfort of their homes and family on Christmas to fight for liberty and freedoms granted by the creator. Bernard -- The Vermont Federation of Sportsmen's Clubs (VTFSC) and the Vermont State Rifle & Pistol Association (VSRPA) were parties to an Amicus brief in this case, Duncan v. Bonta (formerly Duncan v. Becerra) before the U.S. Ninth Circuit Court of Appeals. This is the case challenging California's ban on mere possession of so-called large capacity magazines.  The District Court had declared the ban unconstitutional, and a three-judge panel of the Ninth Circuit agreed.   The brief of the gun rights was filed in the proceedings before the En banc panel. The Ninth Circuit has now reviewed the case En banc (a larger group of judges than the three judge panel), and the En banc court has now reversed the panel's decision and upheld the magazine ban.  It is quite possible that this case will be appealed to the U.S. Supreme Court (SCOTUS), as SCOTUS currently has on hold a similar mag ban case that arose from NJ.  The 9th circuit's En Banc decision can be found here. The VTFSC and the VSRPA are parties to an Amicus brief in the case, New York State Rifle & Pistol Association (NYSRPA) v. Bruen, currently before the Supreme Court of the United States, with oral arguments heard on November 3. The VTFSC and the NYSRPA are the NRA State Associations for their respective states. The VTFSC continues it's fight for the sporting rights of all Vermonters, be it F&W issues or 2nd Amendment / Article 16 issues, and we are the only group in Vermont that is registered to lobby for both. Bernard -- On Saturday, May 1 Green Mountain Practical Shooters will be holding a USPSA skills-based clinic. The event will run from 0900-1500. We normally stop for a quick lunch break. For the past few years, we have been grabbing pizza. This event is designed to introduce sports people to the world of USPSA action shooting If you are not familiar with USPSA a quick introduction video can be watched here: Introduction to USPSA Shooting Video We start the day with some group shooting before moving on to static draws and reloads. We then divide the group and work on various movement skills on both live fire and dry fire. You will need a centerfire handgun. 9mm or greater. 3 magazines a holster, belt, and mag pouches. 250 rounds of ammo we probably will not go through that much but is better to have extra. Water, snacks, and eye and ear protection. Bernard -- S.129 - No More Action This Year  Senator Chris Bray, Chair of the Senate Natural Resources Committee, announced in the Senate Democratic Caucus weekly meeting today that S.129, the bill to remove the jurisdiction of the F&W Wildlife Board to enact or amend hunting and fishing regulations, will be held off until next year.   It is concerning that Chair Bray appeared to convey that it was no major point that that the purpose of S.129 was to remove the authority of the F&W Board to review the research and testimony of the well qualified personnel of the F&W Dept, and the testimony of the public, in enacting and amending the regulations governing hunting and fishing. Chair Bray failed to mention that the entire board would be disbanded, with the 12 new members being politically appointed.   The F&W Board has a long history of providing extremely viable regulations for hunting and fishing in Vermont.   Those advocating for stripping the Board of the jurisdiction to continue in its service have put forward an incorrect understanding of the relationship and interaction between the VT F&W Department and the F&W Board.   The VTFSC will be planning our opposition to S.129 across the rest of this year so we will be ready in January 2022.  We will continue to watch House Committee on Natural Resources, Fish & Wildlife for movement of H.167, H.172, H.317 and H.411.   Sen. Bernard -- IMMEDIATE ACTION REQUESTED Vermonters in general, and Vermont sportspeople specifically, have a very close relationship with both the land and it's wildlife.  Things like hunting, trapping and fishing are more than just hobbies or pastimes.  They are a way of life for many Vermonters; they have been a way of life for over 240 years; with these activities being a critical and necessary part of effective wildlife management. With less than a day's notice, bills are now in play that would BAN Trapping (H.172) and Bear Hounding (H.172 and H.316).  Then there is H.167, an ill-conceived behemoth bill  that criticizes how ANR functions, and then attempts to fix a problem that doesn't exist by adding another layer of bureaucracy to control the ANR and the F&W Board. Also, we are now dealing with H.411, this is year's version of Wanton Waste, which we have concerns with. Whether you Trapper or Bear Hounder doesn't matter:  We all stand together or are hung separately. In testimony concerning H.172, Representative Jim McCullough stated that Vermonters were DEMANDING this bill because he received 472 emails in support.  Only 472 emails?  Since it is apparent that Rep McCullough thinks that hearing from 0.07% of Vermonters is enough to influence the Committee - let's slam them with THOUSANDS!  Rep. McCullough's comment on banning trapping can be seen here; his comment on hounding is seen here. Please do the following, which will involve sending 3 emails: Using the EMAIL LIST below, select all of the emails and then paste them into the "To:" portion of an email. For Email #1, use a Subject Line of "NO to H.167" For Email #2, use a Subject Line of "NO to H.172" For Email #3, use a Subject Line of "NO to H.316" For each email, type a short message, but please keep it clean. Tell them that Vermont's Traditions and Heritage are off-limits; that they should NOT be focusing on ANY non-Covid or non-budget bills until normalcy returns, and that you DEMAND these bills die in Committee.  Repeat 3 times, 1 for each bill. Then forward this email to your friends and ask them to help. We Need Numbers!
