 On Christmas Eve 1776 General George Washington and 2400 soldiers braved the freezing cold and ice to cross the Delaware river to attack a garrison of Hessian soldiers under the command of the British crown stationed near Trenton New Jersey.
These brave men left the comfort of their homes and family on Christmas to fight for liberty and freedoms granted by the creator. Many of these men made the ultimate contribution to freedom with their lives.  
Let us not forget the battles for freedom that our ancestors paid for with their lives so that we may live today in these United States of America. 
We wish all a very Merry Christmas and Happy Holidays.

The Vermont Federation of Sportsmen's Clubs (VTFSC) and the Vermont State Rifle & Pistol Association (VSRPA) were parties to an Amicus brief in this case, Duncan v. Bonta (formerly Duncan v. Becerra) before the U.S. Ninth Circuit Court of Appeals.

This is the case challenging California's ban on mere possession of so-called large capacity magazines.  The District Court had declared the ban unconstitutional, and a three-judge panel of the Ninth Circuit agreed.  

The brief of the gun rights was filed in the proceedings before the En banc panel.

The Ninth Circuit has now reviewed the case En banc (a larger group of judges than the three judge panel), and the En banc court has now reversed the panel's decision and upheld the magazine ban.  It is quite possible that this case will be appealed to the U.S. Supreme Court (SCOTUS), as SCOTUS currently has on hold a similar mag ban case that arose from NJ.

The VTFSC and the VSRPA are parties to an Amicus brief in the case, New York State Rifle & Pistol Association (NYSRPA) v. Bruen, currently before the Supreme Court of the United States, with oral arguments heard on November 3.

The VTFSC and the NYSRPA are the NRA State Associations for their respective states.

The VTFSC continues it's fight for the sporting rights of all Vermonters, be it F&W issues or 2nd Amendment / Article 16 issues, and we are the only group in Vermont that is registered to lobby for both.

On Saturday, May 1 Green Mountain Practical Shooters will be holding a USPSA skills-based clinic.

The event will run from 0900-1500. We normally stop for a quick lunch break. For the past few years, we have been grabbing pizza.

This event is designed to introduce sports people to the world of USPSA action shooting If you are not familiar with USPSA a quick introduction video can be watched here: Introduction to USPSA Shooting Video

We start the day with some group shooting before moving on to static draws and reloads. We then divide the group and work on various movement skills on both live fire and dry fire.

You will need a centerfire handgun. 9mm or greater. 3 magazines a holster, belt, and mag pouches. 250 rounds of ammo we probably will not go through that much but is better to have extra. Water, snacks, and eye and ear protection.

S.129 - No More Action This Year 

Senator Chris Bray, Chair of the Senate Natural Resources Committee, announced in the Senate Democratic Caucus weekly meeting today that S.129, the bill to remove the jurisdiction of the F&W Wildlife Board to enact or amend hunting and fishing regulations, will be held off until next year.
 
It is concerning that Chair Bray appeared to convey that it was no major point that that the purpose of S.129 was to remove the authority of the F&W Board to review the research and testimony of the well qualified personnel of the F&W Dept, and the testimony of the public, in enacting and amending the regulations governing hunting and fishing. Chair Bray failed to mention that the entire board would be disbanded, with the 12 new members being politically appointed.
 
The F&W Board has a long history of providing extremely viable regulations for hunting and fishing in Vermont.
 
Those advocating for stripping the Board of the jurisdiction to continue in its service have put forward an incorrect understanding of the relationship and interaction between the VT F&W Department and the F&W Board.
 
The VTFSC will be planning our opposition to S.129 across the rest of this year so we will be ready in January 2022.  We will continue to watch House Committee on Natural Resources, Fish & Wildlife for movement of H.167, H.172, H.317 and H.411.

Action Alert To All Vermont Sportspeople

Last week we asked you to contact the House Committee on Natural Resources and Fish & Wildlife on H.167, H.172 and H.316, and you responded in force.  While it was a GREAT start, as there are still weeks left in this session:  There is more work for us to do.

Last week, the Senate Committee on Natural Resources and Energy began taking testimony on S.129, which is yet another bill that attacks the authority and composition of the Fish & Wildlife Board so that Vermont traditions such as trapping and hounding can be banned.  S.129 will disband the entire board, remove their authority, and will create a new 12-member "advisory" board with 8 of those 12 being politically appointed by the majority party and 4 by the governor.

The F&W Department and the Fish & Wildlife Board act not only to uphold the right of Vermonters to "hunt and fowl" per Article 67 of our Constitution; they work tirelessly to protect Vermont's wildlife and by all accounts they are both doing stellar work as our game wildlife is abundant and flourishing.  Just like H.167:  S.129 is politically motivated and is not needed.

PLEASE do the following IMMEDIATELY, which will involve sending a single email to all Senate Natural Resources and Energy committee members, and a single email to House Committee on Natural Resources & Fish & Game:

  1. Start a new email, copy & paste the recipients into the ".." box (copy & paste info is at the bottom)

IMMEDIATE ACTION REQUESTED

Vermonters in general, and Vermont sportspeople specifically, have a very close relationship with both the land and it's wildlife.  Things like hunting, trapping and fishing are more than just hobbies or pastimes.  They are a way of life for many Vermonters; they have been a way of life for over 240 years; with these activities being a critical and necessary part of effective wildlife management.

With less than a day's notice, bills are now in play that would BAN Trapping (H.172) and Bear Hounding (H.172 and H.316). 

Then there is H.167, an ill-conceived behemoth bill  that criticizes how ANR functions, and then attempts to fix a problem that doesn't exist by adding another layer of bureaucracy to control the ANR and the F&W Board.

Also, we are now dealing with H.411, this is year's version of Wanton Waste, which we have concerns with.

Whether you Trapper or Bear Hounder doesn't matter:  We all stand together or are hung separately.

In testimony concerning H.172, Representative Jim McCullough stated that Vermonters were DEMANDING this bill because he received 472 emails in support.  Only 472 emails?  Since it is apparent that Rep McCullough thinks that hearing from 0.07% of Vermonters is enough to influence the Committee - let's slam them with THOUSANDS

Please do the following, which will involve sending 3 emails:

  1. Using the EMAIL LIST below, select all of the emails and then paste them into the "To:" portion of an email.
  2. For Email #1, use a Subject Line of "NO to H.167"
    For Email #2, use a Subject Line of "NO to H.172"
    For Email #3, use a Subject Line of "NO to H.316"
  3. For each email, type a short message, but please keep it clean. Tell them that Vermont's Traditions and Heritage are off-limits; that they should NOT be focusing on ANY non-Covid or non-budget bills until normalcy returns, and that you DEMAND these bills die in Committee.  Repeat 3 times, 1 for each bill.

This afternoon, gun control bill S.30 was passed in the Second Reading by a vote of 20-9.

A roll call was taken and when the Senate Journal is published later today it will be available for inspection.

The bill will now move to Third Reading tomorrow.  Opposing the bill on third reading is quite important.

S.30 - THE BEGINNING OF THE END OF CONCEALED CARRY

The Federation respectfully requests that interested parties immediately contact their Senators both by email and phone to politely ask that they vote NO on S.30.

To get your Senator's contact information (email & phone), go to this page. Find your Senator(s) either by name or your county, click on their name, and you will get their contact info.  Then please drop them a quick email that says "Please vote NO to S.30" and call their number to leave the same message. 

S.30 is really not about hospitals as it does not offer any more protection for hospitals than what exists today.  S.30 is about establishing the framework that will support the further erosion of a Vermonter's ability to bear arms and defend themselves in the future.

Summary of S.30

If someone with evil intent wishes to do harm in a hospital, it must be understood by all that a sign will not stop them any more than the implementation of S.30 will, which carries the weight of a misdemeanor.  It likely will only stop honest citizens who do not wish to run afoul of a law, but even with them there is the element of human nature which brings along the failings of being forgetful, not being  mindful of their location, or being pre-occupied with other thoughts and stresses which would not be uncommon at a hospital.

Unless the investment is made is screening equipment and more security personnel to be located at hospitals, just as there has been at courts and at schools, it is less than fair to equate them as being "equal" in terms of inherent protection already in place.

Is this legislation about safety, or is it the first of many steps at gun control that is a direct assault on our Vermont traditions and culture through slow diminishment, with the final result being the elimination of our federal and state constitutional rights?

S.30 v. 13 VSA 3705

It remains the stance of the Federation that 13 VSA 3705 more than adequately addresses the intent of S.30.  Not only is 13 VSA 3705 already widely in use for that expressed purpose (such as at hospitals and government buildings), it seems that it is working and working exceptionally well given that we do not seem to be able to identify even a single issue here in Vermont that has occurred at a hospital (or day care or government building).

Using 13 VSA 3705 allows for an exceptionally high degree of discretion on the part of law enforcement in determining the trespasser's intentions, thereby allowing for mistakes or unthinking actions to be handled without any penalty, while still allowing a coherent mechanism to remove both the person and the firearm if warranted with criminal liability.  This as opposed to a strict criminal liability as envisioned in S.30.

A small but nonetheless key point to the use of 3705 - something that there have been several misstatements made about - is that there is no requirement for someone in authority at location where firearms have been prohibited to attempt to confront a trespasser BEFORE police are called  That is an incorrect understanding as it is in fact normal, and in many cases routine, for someone to call the police FIRST, and once the police arrive the trespasser is THEN confronted.

No one at a hospital needs to confront someone prior to police being called, police can be called immediately to then handle any subsequent possible "confrontation". 

Definition of Hospitals

The definition of Hospitals is found in statute in 18 VSA 1902.  To date, it would be the Federation's understanding that all of the discussion concerning "Hospitals" has centered only on those buildings which fit the commonly excepted definition of a hospital, and we believe that that definition is found in 1902(1)(A) only.  The other 7 definitions however, which would (1)(B)-(H), significantly broaden that definition, such that the scope well exceeds what we understand was the intended goal of "true" hospitals.

For example, the Central Vermont Medical Center's website indicates that that organization provides care at not only Central Vermont Hospital, as well as an additional 23 community-based medical group clinics and local physician practices, including two "ExpressCare" facilities that are open 7 days a week, as well as Woodridge Rehabilitation and Nursing facility.

 Schools and Courts vs Hospitals

A primary argument we have heard regarding the need for S.30 is that, since legislation was passed that addressed firearms at schools (13 VSA 4004) as well as prohibiting firearms in courts (13 VSA 4016), there should be no issue whatsoever with accepting a similar law concerning Hospitals, even though we have 13 VSA 4003 (Carrying Dangerous Weapons) which specifically speaks to carrying a weapon with intent to harm others.

In considering 13 VSA 4004 (Firearms at Schools), section (a) states that: "No person shall knowingly possess a firearm or a dangerous weapon while within a school building or on a school bus."  Section (b) states that:  "No person shall knowingly possess a firearm or a dangerous or deadly weapon on any school property with the intent to injure another person.

While we note that the latest amendments for S.30 now include "knowingly", we feel that it is proper to add the element of "intent" - which was part and parcel of 13 VSA 4004.  Beyond that, if anyone has recently tried to get into a school recently, they will find an extremely heightened level of security whereby there is some fairly intense screening involved in order for someone to even get inside a school building.

In considering 13 VSA 4016 (Firearms in Court), it is the Federation's understanding that virtually all court buildings have both armed court security personnel present, in addition to screening equipment, both of which would serve to INSURE that no firearms are brought in.

Without the investment in security personnel and related screening equipment, creating "gun free zones" will not stop someone who is determined, but it will force law-abiding citizens who typically and routinely provide for their own means of defense from either forgoing entry, risk a strict criminal liability and corresponding criminal record, or otherwise swap away their means of defense for the illusion of security.
