Update on H.230

Given the super-majority in the House, its is not surprising that they voted H.230 through; I regret to say that it passed out of the House today despite strong opposition and amendments from our allies.
 
Despite the "Safe Storage" piece being unconstitutional by both Heller and Bruen - the majority passed it anyway - pretty much entirely on the strength of our illustrious Attorney General Charity Clark. In her testimony, which lasted less than 10 minutes, she said the whole thing was Constitutional, and she supported it.
 
Ms. Clark's statements were diametrically opposed to that of the Vermont Defender General's Office - who said the whole bill was unconstitutional - and spent well over an hour across two sessions explaining why.
 
And then you had Legislative Counsel who basically shrugged on the question of constitutionality, and said "It's unclear".
 
So the super-majority ruled, they blindly voted for it even over constitutional concerns, and they even voted against a simple amendment that would have allowed for more expansive reporting on suicides with firearms, such as where the firearm came from, whether the person committing suicide had a terminal disease, or whether or not they owned the gun.
 
In talking with the powers that be, I regret to say that a common theme was: "We'll pass it and let the Senate fix it".
 
Our fight now moves away from the House and onto the Senate. We expect that it will go through both Senate Health Care and then Senate Judiciary.
 
The Senate now becomes our target - stay tuned for further info - and Thank You for standing with us as we fight these unconstitutional laws.

We will keep you informed of how else we can fight this bill, and we are considering all options.

This week, the House Judiciary Committee has picked up and modified H.230: An act relating to implementing mechanisms to reduce suicide.  This is a priority bill, and it was just voted out of House Judiciary - so it made crossover (which is today).

From our perspective, there are three substantive parts:

  • Safe Storage / Child Access Protection (CAP)
  • Expansion of Extreme Risk Protection Orders (ERPOs)
  • 72-hour Waiting Period

Safe Storage / CAP

The Federation fully supports that firearm owners need to be responsible with the firearms they own. We also however understand that the Supreme Court of the United State (SCOTUS) ruled in DC v Heller that it is unconstitutional to require a person to have all of their firearms locked up or inoperable.

Requiring that all of your firearms be locked up is also unconstitutional under NYSRP v Bruen.  Under Bruen, if a law impacts the 2nd amendment, it is presumptively unconstitutional UNLESS that law is in line with historical analogue and tradition.

There is no such historical analogue that required citizens to keep their firearms locked up as this defeats the ability to use a firearm for self-defense.  Constitutionally:  The need to be able to immediately respond to a violent confrontation is an unalienable right that supersedes the State's interest in trying to keep people safe.

Expansion of ERPOs

H.230 looks to expand the people who can file an ERPO to include Family and Household Members, whereas currently an ERPO can only be filed by the Attorney General or State's Attorney.  Today, nothing prevents anyone from contacting the AG's Office or State's Attorney with an ERPO request, we are not aware of such requests being turned down, and we believe it is proper to have some vetting of the legitimacy of an ERPO case BEFORE it gets submitted into our court system which already has a significant backlog as Judge Zonay pointed out.

Our real complaints with existing ERPO law is two-fold:  We believe that the standard of evidence is too low (Preponderance as opposed to Clear and Convincing) for a Temporary ERPO, and futher that these laws allow for firearms to be relinquished / confiscated without Due Process - which is fundamentally unconstitutional.

72-Hour Waiting Period

In testimony before the House Committee on Health Care (HCHC), there were only 2 incidents brought to light where a person who was intent on suicide went to a gun store, bought a firearm and then immediately used it to kill themselves.

There is no question that these are two very tragic deaths, performed by people who were intent on taking their own life.

Across that same 10-year period of time however, and according to the FBI NCIS data, there were 440,881 background checks completed in Vermont.

It is not unreasonable to think that out of all those 440,881 sales, there were some number who purchased them specifically because they felt their lives were in danger, or they otherwise felt they would be more secure with a firearm for self-defense.

Losing a life to suicide is devastating.

It would be at least as devastating to lose the lives of people who wanted to live, but who were denied the ability to purchase and possess a firearm in a rapid manner when they could pass a background check.

Under Bruen, a waiting period will be found to be unconstitutional for anyone who already owns a firearm, and it will likewise be found to be unconstitutional for someone who doesn't.

Martin Luther King is quoted as saying "A right delayed is a right denied".

What part of that does this Legislature not understand?

Summary

H.230 was passed out of Committee this morning, 7 For with 4 Against, with that 4 including 1 Democrat who is also a lawyer.

We expect a spirited fight on the House floor when H.230 gets there, and then it will be on to the Senate where we will continue to fight this unconstitutional bill.  This is NOT really a "gun bill".  It is a bill about our Constitution and the protections that our Bill of Rights provide, with the result being that many of our legislators are happily rationalizing their need to thumb their nose at SCOTUS, and are emotionally moving onto unconstitutional ground that will force court action where Vermonters will pay to defend an unconstitutional bill.

It's SHAMEFUL.

We will provide you with further updates, but for the moment please take the time to find your Representatives, and then contact them about your concern over them ignoring our Constitution and their Oath of Office.

Dr. Lott Presentation is Cancelled.

We deeply regret to inform you that the Presentation of Dr. Lott, currently scheduled for tomorrow night March 4th, is being cancelled due to the incoming storm.

Right now, Central Vermont is expected to receive up 1o 18" of snow, and not only will this effect driving and parking:  It will likely effect Dr. Lott's flight arrangements.

We will look to re-schedule Dr. Lott at the earliest available opportunity, but discretion is the better part of valor in this case.

We are sorry for any inconvenience, but we cannot control the weather.

Why Some Gun Laws Make Vermont Less Safe

This FREE presentation, brought to you by the VTFSC and GOVT, will occur at the Pavilion Auditorium in Montpelier on March 4th, 2023, starting 6PM.  Due to limited seating, we only require that you RSVP.

This event will start with a 1 hour Meet & Greet with Dr. Lott, with light refreshments being served.  Dr. Lott's presentation will then begin at 7PM, and will go for about an hour.  Copies of several of Dr. Lott's books will be available for purchase and signing immediately after the event at the Capitol Plaza, which is right across the street from the Pavilion Auditorium.

If you are not aware of who Dr. John R. Lott is:  He is an economist and a world-recognized expert on guns and crime, and he is the president and founder of the Crime Prevention Research Center. Most recently he served as the Senior Advisor for Research and Statistics in the Office of Justice Programs and then the Office of Legal Policy in the U.S. Department of Justice. Lott has held research or teaching positions at various academic institutions including the University of Chicago, Yale University, the Wharton School of the University of Pennsylvania, Stanford University, UCLA, and Rice University, and was the chief economist at the United States Sentencing Commission during 1988-1989. He holds a Ph.D. in economics from UCLA.

Nobel laureate Milton Friedman noted: "John Lott has few equals as a perceptive analyst of controversial public policy issues."

Lott is also a prolific author for both academic and popular publications. He has published over 100 articles in peer-reviewed academic journals and written ten books, including "More Guns, Less Crime," "The Bias Against Guns," and "Freedomnomics." His most recent books are "Dumbing Down the Courts: How politics keeps the smartest judges off the bench" and "Gun Control Myths."

He has been one of the most productive and cited economists in the world (from 1969 to 2000 he ranked 26th worldwide in terms of quality-adjusted total academic journal output, 4th in terms of total research output, and 86th in terms of citations). Among economics, business, and law professors his research is currently the 14th most downloaded in the world. He is also a frequent writer of op-eds.

This venue is a new for the VTFSC, and we hope to make it a success with your involvement.
