The House Natural Resources Committee is taking up several bill of interest on Wednesday 1:15PM, March 30.

The bills are S.201, S.281 and H.5.  You can view the committee hearing at it happens at this link.  We are also watching H.411, which will be picked up by the Senate Natural Resources & Energy Committee at some point; update below.

S.201

This bill was amended to be a bill for adopting trapping "best practices".  It passed the Vermont Senate on a voice vote and was assigned to the House Natural Resources Committee on Friday, March 25, supported by DF&W, VTFSC and VTA.

S.281

This bill would have banned hunting coyotes with dogs. It was amended to be a regulatory bill that would set requirements similar to those used for hunting bears with dogs, supported by DF&W and VTFSC.

S.281 is on Page 2195 of  the Action Calendar of the Senate Calendar for Tuesday, March 29

This bill to allow the use of firearm suppressors when hunting.

H.411(Now in Senate Natural Resources & Energy)

The bill for use of covered animals - often called "wanton waste".  This issued has been kicked around in legislation for quite a few years.  Last year it looked like agreement on a bill had been achieved, and it fell apart.  This year H.411 did pass out of the House with both DF&W and VTFSC support.

It is currently in the Senate Natural Resources Committee and has been introduced.

As you likely know, S.4, which became the replacement for the vetoed S.30, has now passed the House and Senate with blazing speed.

The text of S.4 can be seen here.

Regarding section 1 (13 VSA 4023):  The State of Vermont already had a statute, 13 VSA 3705, that works to keep guns out of hospitals.  When the bill was initially submitted it also included Day Cares and Government buildings – but those facilities were later removed because their representatives indicated that 3705 worked very well for them. 

In regards to how 4023 will be enforced:  It is an identical process to 3705.  With 3705:  Law Enforcement could be called without any need to confront anyone, and Police could then use discretion to resolve a conflict, with the outcome being fines and even jail time if the situation could not be amicably resolved.  This as opposed to having strict liability, no discretion, no jail time and only a minor fine with 4023. 

We acknowledge that hospitals are places where emotions can run high.  We do not however believe that this new law will stop violence in hospitals if someone is intent on carrying out such a heinous deed, and we conjecture that the number of people who may be cited under this new law will be zero.

Regarding section 2 (13 VSA 4019):   The VTFSC agrees that firearms should not be possessed by people who should not have them.  We believed however that there was solid rationale for the Default Proceed to occur after 3 full business day as per Federal law, and that in those very rare situations where a firearm was allowed to be transferred due to a Default Proceed:  They were followed up on by the FBI/ATF.

Regarding Section 6 (15 VSA 1104):  Studies show that violence decreases AFTER an RFA is filed.  We know that temporary RFA cases are decided by the weight of a feather.  We know that when a temporary RFA is granted, over 50% of the time those cases never go to a Final Hearing due to the cases being withdrawn or dismissed, which means property will be seized just to be given back within two weeks.  We know that at one point, it was stated that it was a "rare" occurrence that a judge would order relinquishment in a temporary RFA, but we now know that these are now occurring with greater frequency.

While we can now say that DV violence goes down after a RFA is filed for the simple reason that there is now visibility on that DV situation, we are deeply concerned that this may well foment violence when people have their possessions taken without the Due Process of law, without any liability for damage to those firearms being stored and transported back and forth.

The VTFSC ask you to do the following:

Governor Scott -

While the change of 30 to 7 days was a step in the right direction with S.4, serious issues remain in sections 1, 2 and 6.  With section 6 in particular, the concept of Due Process has been stepped on, and this does not align with current Federal Law.

PLEASE:  Veto S.4

S.4 passed the House, but not with a veto-proof majority; we still have a chance to kill this bill - Governor willing.

I start with my most heartfelt Thank You for all of your assistance in helping us to steer these bills.  We did VERY WELL all things considered, especially since two bills were outright bans, and those bans were killed.

Our concerns were with S.129 (Change the F&W Board), S.201 (Anti-Trapping) and S.281 (Ban on hunting coyote with dogs).

S.129
As previously reported, and as a result of your contacting Senators and the Committee, it was realized that this would need far more time to discuss.  This issue is not dead, just set aside, but we now have time to further discuss that this change is not needed.  This was a GOOD outcome for us.

S.281
There will be a temporary moratorium on coyote hunting with dogs while the F&W Department and the F&W Board make rules that will cover this activity.  While we dislike the moratorium, thanks to your response the committee veered away from making all land in Vermont posted by default which would have essentially killed this activity.  This outcome is light years ahead of an outright ban, especially considering that our opposition poured gobs of money into pushing for an outright ban.

S.201
There is no question this bill gravely concerned us.  In response to this threat, you responded.  Also:  The Vermont Trappers Association (VTA) voted to petition the F&W S.201 to require traps that conform to Best Management Practices (something they are already doing).  The actions by you and the VTA likely saved Vermont from an outright ban, and we are pleased with this outcome.  We are especially pleased given the tons of money and "lobbying" done by our opposition that demanded nothing less than a complete ban.

Again:  Thank you for taking the actions we asked for.  Your responses were pivotal in making these outcomes a reality.

The Senate Natural Resources & Energy Committee still has 3 anti-F&W bills in front of them, S.129 (Change the F&W Board), S.201 (Anti-Trapping) and S.281 (Ban on hunting coyote with dogs).

At the present time, it appears that S.129 has been pushed off after it was realized that it would need more work; discussion is schedule for tomorrow but NOT any vote.

With S.281, it currently appears that there will be a temporary moratorium on coyote hunting with dogs while the F&W Department and the F&W Board make rules that will cover that activity.  This bill is NOT on the agenda for tomorrow, but agenda's change quickly.

S.201 is still on the Committee's agenda for tomorrow, 3/11, with a 1/2 hour scheduled for "mark up and vote".  We remain deeply concerned about this bill.

We have asked much of you for over the last many weeks, but we need to insure that there is no action on S.201, because banning foothold traps will have many negative effects, and we need look no further than what happened in Massachusetts after they banned trapping. 

Trapping is heavily regulated; you need to have training and be licensed to trap; and there many benefits to trapping - not the least of which is that trapping is one of the most effective tools at managing certain games species to insure that their population stays sustainable.

      Banning foothold traps without allowing for Best Management Practices (BMPs) to be applied to all foothold traps on land ignores the fact that foothold traps are the most effective method of catching certain games species.

      Until and unless Vermont has mandated that only traps that conform to BMPs can be used, any contemplated ban is premature.

      Trapping is needed to control and manage certain species, some of which are nocturnal, with all being elusive and wily.

      S.201 is a bill that usurps the power that has been given to the F&W Department and the F&W Board, and they should be given the chance to act on establishing rules that will require that only traps that conform to BMPs are utilized.

      Please do NOT let emotions rule; commons sense must prevail with the recognition that game species MUST be managed, and traps are an effective tool.

As you already know, the Senate Natural Resources & Energy Committee has 3 anti-F&W bills in front of them, S.129 (Change the F&W Board), S.201 (Anti-Trapping) and S.281 (Ban on hunting coyote with dogs).  ALL of the Committee members sponsored S.281, with both S.201 and S.281 sponsored by single committee members.  These bills are their "pet" bills, and they quite literally waited until the 11th hour before crossover to move them.

Per a discussion by the committee on 2/28:  There is the intention to MOVE AND PASS all three, which would not allow enough time for testimony, let alone thoughtful deliberation.  They are on a mission.

If you hunt coyote with hounds:  This committee has its sights set on you and your activity.  The committee and its members have been drowned in the continued and un-relenting bleating of anti-hunting groups, with one of those groups wanting nothing less than an end to the use of hounds on ALL game.

How F&W rules and regulations get created, and who creates them is under attack.  Trapping is under attack.  Coyote hunting with dogs is now under attack, and if bills such as these get passed, the Antis will have a template to go after every other type of hunting with dogs.  That would include rabbit hunting and bird hunting, both time-honored sporting activities.

While there is the appearance that the committee *may* move away from an outright ban on hunting coyote with dogs in S.281:  A temporary ban is being contemplated while the F&W Department works on establishing rules/regs that would allow this to continue, hopefully following rules/regs that are similar to bear hounding.

Looking at what is currently proposed for S.281, if a violation occurs it is a loss of license for 5 years and a fine of between $400-$1,000.  Subsequent violations are $2,000-$4,000.  Those are Big Game fines.  Worse than that: 

  • Radio/GPS/telemetry collars are banned;
  • The use of bait is banned;
  • It requires that the dogs be under "control" (I.E., "leashed"); and,
  • If your dog manages to get on posted property: You are fined for trespass.

This is your wakeup call.  Maybe you don't hunt coyote with dog; but there are many that do, and coyote hounding *IS* an effective method of managing coyote. 

Maybe you don't trap, but there are many that do, and trapping *IS* an effective method of managing certain game species. 

Maybe you think things will be fine by having the Antis stack the members of the F&W Board, but you must realize that this is nothing more than a backdoor way of banning all sorts of activities that we participate in, and have for years.

      Senate Natural Resources & Energy Committee

      There is simply no time for you to properly address either S.129 or S.201 this year.  Both of these bills need a great deal of vetting and testimony, coupled with the type of thoughtful deliberation that the Senate is known for and which Vermonters expect.  There is no urgent need for either bill; the "public hearing" you conducted was exceptionally one-sided and poorly executed (such that it did not allow you to hear equally from people interested in these bills; with innumerable people denied the ability to sign-up process due to erroneous error messages that the registration was full.

      Please set S.129 and S.201 aside for consideration next session.

      Regarding S.281:  Coyote hounding is very similar to bear hounding, and I note that a there has been at least one
      Legislative Resolution passed that specifically recognized that "hunting with sporting dogs" was previously supported, apparently unanimously, by the House AND Senate with H.C.R 233.  I quote from that Resolution: 

      "BE It Resolved by the Senate and House of Representatives:  That the General Assembly celebrates the historic, cultural and economic roles of hunting and hunting dogs in Vermont."

      Why is your committee so drastically deviating from that Resolution?

  • Email your Senators
    The Federation now has the capability to allow you to easily send emails to your Senators. To use this feature, please go to THIS WEBPAGE.  The page may take a minute to load, but once it does you will see 4 boxes, each representing a different bill:  129; S.201; S.281 and S.30/S.4.  Click on the "EDIT AND SEND EMAIL" button on each one you support.  Then:

    1. Your name prefix (required)
    2. Your full name (required)
    3. Your email address (required)

    4. Entering the above SHOULD change the name(s) of the Senators to be your Senators, and if so, just click the "SEND" button.

      If it does not properly resolve your Senators, click the "Not your Rep?" link in the lower left corner of the window.  You can then enter your address, which SHOULD resolve to your Senator(s).

      If it still cannot resolve your Senators, pick a residential address close to you from your phone book, then click "SEND".

These two things will take maybe 10 minutes of your time, and may well make all the difference in ANY of these bills moving.  The fact remains that S.281 looks like it will move; and the others may move.

You can either help stop these bills, or not do anything and let others step up and defend our rights.  Once you have acted, forward the link to this page to your friends, family and acquaintances.  This is our fight to lose.

In our continuing efforts to allow Vermonters an easier way to voice their frustrations to Representatives and Senators regarding bad legislation, the VTFSC has invested in an add-on to our website that allows you to communicate via email to our legislators in an easier fashion.

All you need to do is go to this webpage

The page may take a few seconds to load, but when it completes you will see 4 "Take Action" windows for S.129, S.201, S.281 and S.30/S.4. 

Click on each one that you are concerned about (hopefully all 4) one-at-a-time.  For each one, enter your name prefix ("Mr.", "Mrs." "Ms."), your name and email address (all 3 required).  Then review that the Senators that were auto-selected to insure they are correct for your residence (if they are not click the "Not Your Reps?" link), and you can then just click "send" or you can change the pre-written message and then click "send".

PLEASE BE POLITE - you are representing ALL of us.

We will be enhancing this capability near term, but given what is going on right now in Montpelier - you need to take action NOW.
