Sportsmen's Alliance and Vermont Hunters, Sue to Restore Refuge Rights

On Sept. 14, the Sportsmen's Alliance Foundation, joined by the Vermont Traditions Coalition, Vermont Federation of Sportsmen's Clubs and the Vermont Bear Hound Association, filed suit against the U.S. Fish and Wildlife Service (FWS) seeking to overturn hunting restrictions on Conte National Wildlife Refuge.

On Aug. 16, 2021, FWS released new regulations governing hunting on the refuge, including major reductions in the bear hound-training season, and the elimination of nearly all hunting with dogs on the Putney Mountain Unit of the refuge.

"Federal law requires FWS to show the public their plans before enactment so they can gather public input," said Todd Adkins, vice president of government affairs for the Sportsmen's Alliance Foundation. "This prevents arbitrary governing and is foundational in a functioning and fair democracy, but the Biden Administration failed to comply, denying Vermont citizens a voice that is guaranteed in law."

"Hunters were completely blindsided by the hunting restrictions because the U.S. Fish and Wildlife Service failed to provide any notice or opportunity for public comment despite the drastic changes," continued Chris Bradley, president of the Vermont Federation of Sportsmen's Clubs. "The government's lack of transparency is the focus of our lawsuit."

"Bear hunters rely on the summer training season to condition their dogs for the fall hunting season," said Doug DeVost, president of Vermont Bear Hound Association. "That training is essential to maintain healthy, well-trained dogs in the field, and yet FWS didn't even give us the courtesy of hearing our input on the impact of this decision."

"The Fish and Wildlife Service had ample opportunity to share their plans to restrict hunting rights on the refuge with Vermont sportsmen and women but completely failed to do so,  leaving it out of their draft plans for Conte, making no mention of the changes in public meetings or other communications.  FWS even stated in a draft hunt plan that the refuge intended to continue the status quo of allowing hunters to hunt with their dogs on the refuge in compliance with Vermont state law," said Mike Covey, executive director of the Vermont Traditions Coalition.

The four organizations believe that the precedent of allowing the federal government to hide new rules while denying public input was too much to ignore. The groups are asking the court to vacate the restrictions and are seeking the reimbursement of legal costs to defend a fundamental and basic tenant of federal law.

Words of Appreciation from VTFSC Leadership

 

Evan Hughes, Vice president of NRA foundation projects and the main legislative liaison for the Vermont Federation of Sportsman's Clubs has passed away.

A man of commitment to his country and countryman. Evan spent his working years of life in service of his country as a soldier, law enforcement officer and with the US postal service. His post retirement life was spent serving the sports men and women of Vermont protecting their rights to hunt, fish, trap and exercise their Vermont article 16 rights as granted by the creator.

Evan tirelessly attended sessions of Vermont legislature for decades. Always keeping guard of the civil liberties of his fellow Vermonters. He monitored legislation at the statehouse, watching and reading bills as introduced, calling to attention those of concern to the sporting community. Sending updates and alerts from his infamous  VTGUNS@aol mailing list.

From his perch in the cafeteria at lunch hour he would note of who was consulting with whom over bills as the moved through the legislative process. He possessed the mind of a barrister and the legislative memory of a savant. Picking up on nuances of bills missed by others. Often quoting statute with unmatched accuracy of content, intent and application. His knowledge and dedication to protecting of our rights was untiring and his highest priority.

 

He inspired many, disagreed with a few, and educated us all. For that we will always be grateful.

 

A celebration of life is being held for Evan at the Barre Elks Club from 11:00am to 1:00pm on Sunday, August 7th.

The Elks Club is located at 10 Jefferson Street in Barre, VT 05641.

The Vermont Federation of Sportsmen's Clubs (VTFSC) and the Vermont State Rifle & Pistol Association (VSRPA) were parties to, and financially supported, an amicus (friend of the court) brief in support of NYSRPA in its challenge to the NY law.

The SCOTUS opinions on this case can be found here.

In short, the court struck down NY's restrictive licensing scheme 6-3, and affirmed the right of self-defense outside the home, while recognizing that there can be restrictions for sensitive places.

In the court's main opinion, and in the three concurring opinions (Alito, Kavanaugh, and Barrett) there were only a handful of citations to pro-gun amicus briefs.  Ours was cited twice, out of the 46 pro-gun briefs that were filed.

The majority opinion was written by Justice Clarence Thomas and there are concurring and dissenting opinions.   

25 states have "Constitutional Carry" and do not require a concealed carry permit.

The VTFSC and VSRPA received the E-mail below from our attorney in our amicus brief in the SCOTUS case that was published today.

As most of you have heard, the Supreme Court issued its opinion in the Bruen case (New York carry case) today.  A copy is attached.

The case was decided 6-3, and establishes quite clearly that Americans have a Second Amendment right to carry a firearm outside the home, and that discretionary permitting systems for carry are unconstitutional.  It refutes just about every argument that the other side has made against the right to carry.  It notes that "shall issue" carry systems appear to be constitutional, unless abused.

Our amicus brief is cited twice by Justice Alito in his concurring opinion, so apparently the Court was paying attention.

The way it works is simple.  We have purchased 30 firearms (rifles, pistols, revolvers and shotguns) for a combined total over $15,500 – with 3 of those firearms worth over $1,000. 

We had 1,000 tickets printed, with each ticket having a unique 3-digit number from 000 to 999, with the price of a ticket being $30.  Each night across the month of June, the Vermont Lottery draws a nightly pick-3 number, and the person holding the drawn 3-digit number is the winner of the firearm designated for that night.  A single ticket being able to win multiple times (if that number is repeatedly drawn).

Anyone can buy tickets, even organizations, and it is a great way to help support the Federation while giving you (or your organization) multiple chances to win some fine firearms.

The winner must be able to pass a background check.  If the winner cannot pass a background check, or does not wish to have the firearm they won, they may instead take a $300 cash prize.

Winner must pick up firearm by 8/1/22 or it defaults to the VTFSC; all firearm transfer regulations will be followed.

We hope that this letter finds you well.

One of the ways the Federation raises money to fight for our F&W and Firearm rights as well a financially support everything else we do is to run raffles, and we are currently running a 30/30/30 raffle.

The way it works is simple.  We have purchased 30 firearms (rifles, pistols, revolvers and shotguns) for a combined total over $15,500 – with 3 of those firearms worth over $1,000. 

We had 1,000 tickets printed, with each ticket having a unique 3-digit number from 000 to 999, with the price of a ticket being $30.  Each night across the month of June, the Vermont Lottery draws a nightly pick-3 number, and the person holding the drawn 3-digit number is the winner of the firearm designated for that night; with a single ticket being able to win multiple times (if that number is repeatedly drawn).  The full list of firearms with the firearm to be won for each day can be found at this link

Anyone can buy tickets, even organizations, and it is a great way to help support the Federation while giving you (or your organization) multiple chances to win some fine firearms.

The winner must be able to pass a background check.  If the winner cannot pass a background check, or does not wish to have the firearm they won, they may instead take a $300 cash prize.

Winner must pick up firearm by 8/1/22 or it defaults to the VTFSC; all firearm transfer regulations will be followed.

The Federation is pleased to report that H.411 - the "Wanton Waste" bill - was unanimously passed by the Senate Natural Resources & Energy Committee this morning, with this bill being unchanged from what passed the House.

In considering this bill, the inclusion of coyote in earlier versions made this bill difficult to deal with, because individual views on coyote differ radically between various group.  Some wish that no coyotes should be killed, with others seeing coyote as pests and nuisance animals.

In testimony on this bill, the idea was put forward that there was no need to hunt or kill coyotes, because coyote populations will self-regulate over time.  The problem with that concept however is that by allowing coyote to hit those elevated population levels, there would be very serious consequences, such as the decimation of smaller games species; increased risk of disease and starvation; in addition to coyote driving out species such as fox that desire the same habitat.

Beyond that:  As the coyote population expands they will push further into urban areas, and with that push will come a significant increase in negative human-coyote interactions than can be tolerated by most Vermonters.

While crow remains a "covered wild animal" in this bill and we argued that crows should also be exempted, coyotes were excluded, and with H.411 we have gained Wanton Waste protection for virtually all other Vermont games species in Vermont - which is not only a HUGE win for our wildlife - it is a concept that virtually all ethical hunters support.

On other fronts:  At this time S.129 (change the Fish & Wildlife Board) is dead, with discussions occurring regarding better inclusion of differing views.  S.201 (Ban on foothold traps) has been transformed into a bill requiring that F&W Department to adopt rules for using traps that conform to Best Management Practices, something that the Vermont Trappers Association fully supports, and even submitted a petition for.

That only leaves S.281 (Coyote Hunting with Hounds).  The Senate changed that bill from an outright ban into a bill to have the Fish & Wildlife Department create rules for hunting coyote, with the Fish & Wildlife Board than promulgating those rules after public input and acceptance by the Legislative Committee on Rules (LCAR).

S.281 is now in House Natural Resources, Fish & Wildlife, with only Commissioner Herrick scheduled to give testimony today at 1:15, and it is scheduled for "possible vote" at 9AM tomorrow.

The Federation and it's allies worked hard on all 4 of these bills, with S.129 being set aside; two outright Bans (S.201 and S.281) being addressed through the rule making process; and finally H.411 which became a bill which the VTFSC could support along with the Fish & Wildlife Department.

Overall:  We could not be more pleased with these results, and we hope and expect that S.281 will also be acceptable.

Last week the House Judiciary Committee had hearings on S.265, a criminal threatening bill.  The bill would make a "special victim" category for just government officials.

Washington County State's Attorney Rory Thibault raised the question of amending S.265 from a misdemeanor to a felony crime, so it could be used to remove the right of firearm ownership by using federal law 18 U.S. Code § 922 (g).

Thibault has done this previously (see down below); his testimony starts at starts in the House Judiciary Committee video at 9:30 (9 minutes 30 seconds).

Thibault's statements are immediately followed by Rep Martin LaLonde bringing up amending Vermont law to make a conviction of the misdemeanor law that S.265 would create the basis for the loss of the right to own a firearm under Vermont law 13 V.S.A. § 4017.

Then Matthew Valerio, Vermont Defender General, testified that S.265 should not be a felony crime.  21:30 (21 Minutes 30 Seconds).  He stated he understands that prosecutors want to pursue the restriction of firearm ownership, but points out that a felony conviction would endanger/terminate other rights of citizenship too.  

Then Harrison Stark, Staff Attorney, ACLU of Vermont testified Vermont's current laws were viable and S.265 was unnecessary.  He also stated that if the legislature were to vote, it should vote for S.265, without amendment.  Testimony at 55:00 (55:00 Minutes).

Prosecutor Thibault and gun control advocate Representative LaLonde (D -South Burlington) are attempting to use S.265 as a means to extend the prohibition of the private ownership of firearms in Vermont.

Watch Washington Country State's Attorney testify before the Senate Judiciary Committee at 50:00 (50 Minutes) advocating the that S.265 be a felony crime:  Not because the crime warranted being a felony, but to be the basis to terminate the gun ownership rights of citizens.

"S.265 is completely unnecessary, as existing law works, and the bill is being misused by Rep. Martin LaLonde as a vehicle for a Gun Control Campaign."

The House Natural Resources Committee is taking up several bill of interest on Wednesday 1:15PM, March 30.

The bills are S.201, S.281 and H.5.  You can view the committee hearing at it happens at this link.  We are also watching H.411, which will be picked up by the Senate Natural Resources & Energy Committee at some point; update below.

S.201

This bill was amended to be a bill for adopting trapping "best practices".  It passed the Vermont Senate on a voice vote and was assigned to the House Natural Resources Committee on Friday, March 25, supported by DF&W, VTFSC and VTA.

S.281

This bill would have banned hunting coyotes with dogs. It was amended to be a regulatory bill that would set requirements similar to those used for hunting bears with dogs, supported by DF&W and VTFSC.

This bill to allow the use of firearm suppressors when hunting.

H.411(Now in Senate Natural Resources & Energy)

The bill for use of covered animals - often called "wanton waste".  This issued has been kicked around in legislation for quite a few years.  Last year it looked like agreement on a bill had been achieved, and it fell apart.  This year H.411 did pass out of the House with both DF&W and VTFSC support.

It is currently in the Senate Natural Resources Committee and has been introduced.
